Section 87-2-8 - Denial, Revocation or Suspension of License8.1. Denial of License - A license will be denied any applicant who:a. fails to make a passing score of 80% on any examination; orb. fails to provide evidence of the required experience and/or qualifications for the class of license.8.2. Suspension or Revocation of License - The State Fire Marshal may upon written complaint or his own inquiry, after notice and hearing as provided by W. Va. Code '29A-5-1 et seq. suspend or revoke the license of any person who holds a license if: a. The license was granted upon an application or documents supporting such application which materially misstated the terms of the applicant's qualifications or experience; orb. The licensee subscribed or vouched for such misstatement by an applicant; orc. The licensee incompetently or unsafely performs electrical work; ord. The licensee violated any statute of the state of West Virginia, any rule lawfully promulgated by an agency of the state of West Virginia or any ordinance of any municipality or county of the state of West Virginia which protects the consumer or public against unfair, unsafe, unlawful or improper business practices; ore. The licensee fails to comply with any rule of the State Fire Marshal promulgated to fulfill his responsibilities under W. Va. Code '29-3B-1 et. seq.
