Section 78-1-2 - Application and Enforcement2.1. Application. This rule applies to any facility maintained by the state or any county or municipality of the state, or any agency or facility operated by an individual, firm, corporation, association, or organization, public or private, for the care of 13 or more children for child care services in any setting if the facility is open for more than 30 days per year per child.2.2. Enforcement. This rule is enforced by the Secretary of the Department of Health and Human Resources.
