Section 65-26-3 - Overview3.1. This rule establishes a benchmarking process for setting average nongovernmental rates for acute care hospitals in West Virginia. Benchmarking simplifies the rate setting process and makes it less burdensome for hospitals to file rate applications. Hospitals receive an automatic adjustment to their rates under the benchmarking system. Hospitals with lower costs and charges receive a higher rate of increase under the benchmarking model.3.2. This rule also establishes the criteria and review process for the approval of discount contracts for the payment of patient care services between a purchaser or third-party payer and a hospital.
