Section 61-38-12 - Local Permit Requirements

12.1. Except for consignment farmers markets, no permit is required for a farmers market or a farmers market vendor selling food and farm products.

12.2. Farmers market vendors shall be subject to any state or federal rules and regulations that apply to certain farm and food products sold at farmers markets or at a consignment farmers market under the Food Safety Modernization Act, 21 U.S.C. §§ 2201et seq., and interstate commerce regulations. The Department is solely responsible for enforcing these regulations.
