Section 45-5-10 - Construction, Modification and Relocation Permits10.1. No person shall construct, modify or relocate any coal preparation plant or coal handling operation without first obtaining a permit in accordance with the provisions of W. Va. Code §§22-5-1 et seq. and the Secretary's rules for review and permitting of new or modified sources, except that coal handling operations which are not "stationary sources" as defined by subdivision 2.24.2 of 45CSR13 are not required to obtain a permit under 45CSR13. The terms "construction", "modification" and "relocation" shall have the meaning ascribed to them in 45CSR13.
