Section 187-3-18 - Arbitration Alternative18.1. Parties may agree to waive their right to a hearing in conformity with Chapter 29A of the West Virginia Code, and instead elect to submit the matter to binding arbitration.18.2. Appeal to the Board from the arbitration decision must be made within thirty (30) days of the decision. The Board in its discretion may choose to grant or deny an appeal petition.18.3. Any party adversely affected by a denial of an arbitration appeal, or by a final order of the Board concerning an arbitration decision is entitled to judicial review or other relief as provided by W.
