Section 150-21-4 - Term of certificates4.1. A certificate shall have a term of five years, unless otherwise ordered by the Commission. A certificate may be extended for one year, on motion of the Commission, Commission Staff or certificate holder. If the Commission finds that an additional extension is necessary to assure continued and uninterrupted TRS to the State, it may extend a certificate for such period(s) as the Commission determines is necessary (additional extension). No other notice or hearing with regard to such extensions shall be required. In the case of an additional extension of a certificate, the TRS provider may request a rate increase.W. Va.
