Section 141-87-3 - GENERALa. Smoking and smokeless tobacco use hanns readiness by impairing physical fitness and by increasing iUness, absenteeism, premature death and health care costs. Readiness and personal he2ilth will be enhanced by establishing the standard of a smoke-free environment that supports abstinence from and discourages use of tobacco. b. Full cooperation of all commanders, supervisors, soldiers, airmen and civilians is expected to ensure people are protected from the effects of second-hand smoke. However, persons who desire to use tobacco products win not be inconvenienced xmnecessarily. An equitable balance must be struck. c. All organizational elements that occupy space in or on conveyances, offices, buildings or facilities over which the WVNG has custody and control will comply with the DOD, DAF, DA and/ or State of West Virginia policies and guidance. d. This policy does not cancel or supersede other instructions that control smoking because of fire, explosion or other safety or operational considerations.W. Va. Code R. § 141-87-3
