Section 114-10-18 - Special Enforcement Procedures

18.1. Filing of advertisements. -- The Commissioner in his discretion may require that an insurer file with this Department, for review prior to use, direct response advertising materials. When so required, such advertising materials must be filed not less than a reasonable time to be specified by the Commissioner prior to the date the insurer desires to use the advertisement in West Virginia.

18.2. Interpretive guidelines; adoption by Commissioner. -- To facilitate compliance with this regulation, the Commissioner may adopt appropriate interpretive guidelines. To the extent not inconsistent with the statutes of this State and this regulation, such guidelines shall be consistent with the interpretive guidelines adopted and revised from time to time by the National Association of Insurance Commissioners for use by the various states in the interpretation of these regulations.
