Section 391-25-570 - Procedure following inconclusive election

In any election in which there are three or more choices on the ballot, if none of the choices receives the number of votes necessary to determine the election, a run-off election must be held providing for selection between the two choices receiving the largest numbers of valid ballots cast in the inconclusive election. Any organization excluded from a run-off election may file objections to specific conduct affecting the results of the inconclusive election. Where the choice of "no representative" is to be excluded from a run-off election, the employer or decertification petitioner may file objections to specific conduct affecting the results of the inconclusive election. Any objections must be resolved before a runoff election is conducted. All run-off elections must be determined as provided in WAC 391-25-530.
