Section 388-829C-290 - What is mismanagement of client funds?(1) Mismanagement of client funds includes any action or inaction by the companion home provider when managing a client's funds that results in: (c) Overdraft and non-sufficient funds fees;(d) A violation of the room and board agreement;(e) Any stolen, missing, or misplaced funds;(f) Expenditures over twenty-five dollars without documentation; or(g) Past-due financial obligations.(2) No more than fourteen days after a companion home provider becomes aware of an error that resulted in mismanagement of client funds, the provider must: (a) Reimburse the client for any mismanagement, including punitive charges, under subsection (1)(a) through (1)(f) of this section;(b) Pay for past-due financial obligations under subsection (1)(g) of this section; and(c) Submit proof of the transaction to the client's case manager.Wash.
