Section 24VAC5-20-190 - Determination of hazard

The Department of Aviation shall conduct an aeronautical study, when needed to satisfy the requisites of this regulation, and to determine the effect of any structure that penetrates any imaginary surface upon the safe and efficient operation of any licensed, military, or government air navigation facility or airport. This determination shall be made based on criteria as defined by 24VAC5-20-200. If a structure constitutes an "obstruction" in accordance with these standards, it shall be presumed to be a "hazard" until determined otherwise the by Virginia Aviation Board.
