Section 20 031 016 - METHODS TO BE USED FOR RETAIL SALE OF FRUITS AND VEGETABLES
A. METHODS USED
1. All fruits and vegetables may be sold in Vermont by net weight, although the usual sale is by count or measure.
2. These methods of sale do not apply to produce grown and sold on the premises such as count, weight, etc. All Vermont packing and labeling requirements must be complied with. If a scale is used, it must be sealed by the Weights and Measures Division.
3. All random weight packages including single items, not to be weighed at time of sale, must be marked with the net weight, price per pound, and total selling price.
4. All packages that are not random weights must comply with the Vermont Packaging and Labeling Regulations. (A copy may be obtained by writing to the Division of Weights and Measures, Vermont Department of Agriculture, 116 State Street, Montpelier, Vermont 05602.)
5. All labels must be of a type or lettering as to be boldly, clearly amd conspicuously presented.
6. The identity if needed can either be on the package or on a sign over the commodity display.
7. When sale is by measure, a bushel must contain 2150.42 cubic inches.
8. Packages when sold by count in trays must be marked if the count isover six (6).
9. If a commodity is allowed to be sold by count, it must be graded by the packer: otherwise, sale must be by net weight.
10. Commodities, when sold by count and having a different price, must have the price displayed and each item must be marked. Example: Two sizes of lettuce pried at 29c and 19c.
