Section R651-700-7 - Disposal of Real Property(1) The division may dispose of real property.(2) Unless otherwise directed by the Legislature: (a) any land disposal may be brought before the Board of State Parks for consultation; and(b) a land disposal under Subsection (a) shall have approval of the director.(3) For purposes of Section R651-700-7, a disposal of land shall constitute a sale or other disposition of land in which the division transfers title to the land that is the subject of the disposal to another person or entity.(4) To t h e extent required by law, the division shall retain subsurface mineral, water, and any other rights attached to the land.(5) If title to any subsurface mineral, water, or any other rights attached to the land are transferred with any real property, the division shall receive full compensation for the rights conveyed unless the land is transferred to another state agency or subdivision in compliance with Subsection R651-700-5(2)(i).Utah Admin.
