Section 817.36 - Administrative Penalties(a) The Commission shall adopt a penalty matrix that will be used to determine the amount of an administrative penalty under Texas Labor Code § 51.033.(b) When evaluating "the seriousness of the violation" under Texas Labor Code § 51.033, the Commission will consider the level of risk of injury or death to a minor.(c) When evaluating "the history of previous violations" under Texas Labor Code § 51.033, the Commission will look at an employer's pattern or practice of violations.40 Tex.
