Section 809.74 - Parent Appeal Rights(a) Unless otherwise stated in this section, a parent may request a hearing pursuant to Chapter 823 of this title: (1) if the parent's eligibility or child's enrollment is denied, delayed, reduced, suspended, or terminated by the Board's child care contractor, Choices caseworker, or SNAP E&T caseworker; or(2) regarding the amount of recoupment determined pursuant to Subchapter F of this chapter.(b) A parent may have an individual represent him or her during this process.(c) A parent of a child in protective services may not appeal pursuant to Chapter 823 of this title, but shall follow the procedures established by DFPS.40 Tex.
