Section 343.334 - Confidentiality(a) All medical and mental health screenings and assessments shall be conducted in a confidential setting consistent with facility operations and security.(b) All interactions between a resident and a health care professional that involve treatment or an exchange of confidential medical information shall be conducted in private. The facility's policies and procedures may authorize a juvenile supervision officer to be present in the following situations: (1) if the resident poses a substantial risk to the safety of the health care professional or others;(2) if the facility has a written policy requiring the presence of a juvenile supervision officer during medical treatment;(3) if the health care professional or resident requests the presence of a juvenile supervision officer during the treatment; or(4) if the circumstances or situation indicate the presence of a juvenile supervision officer is necessary and prudent.37 Tex.
