Section 36.51 - Denial of Application for Certificate of Registration(a) The department may deny an application for a certificate of registration if: (1) The applicant attempts to obtain a certificate of registration by means of fraud, misrepresentation, or concealment of a material fact;(2) The applicant has sold, bartered, or offered to sell or barter a certificate of registration;(3) The applicant or, if applicable, the applicant's on-site representative, is ineligible pursuant to § 36.55 of this title (relating to Disqualifying Offenses);(4) The applicant's certificate of registration was revoked within two (2) years prior to the date of application; or(5) The applicant operated a metal recycling entity in violation of §1956.021 of the Act and, after notice of the violation, failed to obtain a registration required by the Act.(b) Upon the denial of an application under this section, an applicant may request a hearing before the department pursuant to § 36.56 of this title (relating to Informal Hearings).37 Tex.
