(a) Money paid by mistake of fact or mistake of law or in excess of a required fee or charge which is deposited by the Department of Public Safety into the state treasury will not entitle a payor to an automatic refund.(b) Only amounts in excess of $5.00 will be automatically refunded. Amounts of $5.00 or less will be refunded by the department if the payor makes a request for refund in writing within 90 calendar days from the date of deposit.37 Tex. Admin. Code § 1.181
