Section 5.451 - Salary Affidavits: District Judges, Criminal District Judges and Judges of Courts of Appeals(a) To receive a salary payment from the comptroller, a salary affidavit must be completed by all the district judges, criminal district judges, and judges of courts of appeals paid with state appropriations stating: (1) the amount received from sources other than appropriated funds; and(2) the authority by which those funds are received. The salary affidavit must be signed and notarized by the judge.(b) Time for filing. (1) Those judges appointed during the fiscal year must file with the comptroller a completed salary affidavit prior to the end of the first pay period.(2) Those judges holding office at the beginning of the fiscal year or biennium must file with the comptroller a completed affidavit prior to the end of the first pay period in the new fiscal year.(3) Each judge whose supplemental salary amount is changed in any way must file with the comptroller a revised salary affidavit prior to the end of the pay period in which the supplemental salary is altered.(c) Failure to submit the required affidavits will result in a salary payment not being issued until receipt by the comptroller's office of a completed affidavit.(d) Upon receipt of a completed salary affidavit, a copy of the affidavit will be forwarded by the comptroller's office to the secretary of state for filing.34 Tex.
