Section 15.43 - Penalties(a) A state agency may assess a penalty of 5.0% of the payment amount due if: (1) a person subject to Government Code, §404.095 and § 15.1(a) of this title (relating to Applicability and Additional Information) fails to transfer payment by EFT;(2) a person fails to comply with this chapter; or(3) a person fails to comply with those rules adopted by a state agency under Government Code, § 404.095(c).(b) The comptroller will assist state agencies in identifying persons who are not complying with this chapter.34 Tex.
