Section 338.21 - Certification(a) For aboveground storage vessels constructed and brought into service on or before September 1, 2027, an owner or operator must report to the executive director its compliance status with the standards under § 338.5 of this title (relating to Standards) no later than September 1, 2027.(b) For aboveground storage vessels constructed and brought into service on or before September 1, 2027, an owner or operator shall certify compliance under § 338.5 of this title upon completion of the next regularly scheduled out-of-service maintenance of the aboveground storage vessel, but no later than September 1, 2037.(c) For aboveground storage vessels constructed and brought into service after September 1, 2027, an owner or operator of an aboveground storage vessel shall certify compliance under § 338.5 of this title no later than 30 days after the start of operation.(d) The owner or operator shall re-certify compliance with the standards under § 338.5 of this title every 10 years.30 Tex.
