Section 335.331 - Failure to Make Payment or Report(a) Failure to make payment in accordance with this subchapter constitutes a violation subject to enforcement pursuant to the Health and Safety Code, § 361.137 and § 361.252.(b) Generators and owners or operators of a facility failing to make payment of fees imposed under the Health and Safety Code, Chapter 361, when due, shall be assessed late payment penalties and interest in accordance with Chapter 12 of this title (relating to Payment of Fees).(c) Any interest or penalties collected by the commission shall be deposited in the appropriate fund.30 Tex.
