Section 323.22 - Approved Ratings(a) Any person whose waste disposal facility receives an approved rating may erect signs at appropriate locations to inform the public that the department has approved the waste disposal facility. Before any person whose facilities have been approved may erect a sign, he must agree with the board in writing to the following items.(1) to erect a sign only of a design approved by the board;(2) to provide for the proper maintenance of the sign;(3) to display the sign only as long as the facility continues to maintain its approved rating; and(4) to remove the sign immediately when notified by the executive director that the facility is no longer approved.(b) In addition, a city whose facility has been approved must agree to consult with the district engineer of the department of highways and public transportation or his representative as to the location and height of the sign prior to erecting it.30 Tex.
