Section 113.2228 - How do I demonstrate continuous compliance with the emission limitations and the operating limits?(a) You must conduct an annual performance test for particulate matter, hydrogen chloride, and opacity for each commercial and industrial solid waste incineration unit as required under 40 Code of Federal Regulations §60.8 to determine compliance with the emission limitations. The annual performance test must be conducted using the test methods listed in Table 2 in § 113.2261 of this title (relating to Tables Relating to Division 4) and the procedures in § 113.2224 of this title (relating to How do I conduct the initial and annual performance test?).(b) You must continuously monitor the operating parameters specified in § 113.2221 of this title (relating to What operating limits must I meet and by when?) or established under § 113.2222 of this title (relating to What if I do not use a wet scrubber to comply with the emission limitations?). Operation above the established maximum or below the established minimum operating limits constitutes a deviation from the established operating limits. Three-hour rolling average values are used to determine compliance (except for baghouse leak detection system alarms) unless a different averaging period is established under § 113.2222 of this title. Operating limits do not apply during performance tests.(c) You must only burn the same types of waste used to establish operating limits during the performance test.30 Tex. Admin. Code § 113.2228
