Section 7.1913 - Examination of Multiple Employer Welfare Arrangements(a) The commissioner or any person appointed by the commissioner will have the power to examine the affairs and conduct of any multiple employer welfare arrangement (MEWA) and for such purposes will have free access to all the books, records, and documents that relate to the business of the plan and may examine under oath its trustees or directors, officers, agents, and employees in relation to the affairs, transactions, and condition of the MEWA. Examinations of a MEWA will be made in the same manner and with the same frequency that applies to domestic and foreign insurers licensed to transact the business of insurance in this state, including as provided in Insurance Code §1301.0056, concerning Examinations and Fees, for a MEWA that provides a comprehensive health benefit plan that is determined by the commissioner to be structured in the manner of a preferred provider benefit plan or an exclusive provider benefit plan as defined in Insurance Code §1301.001, concerning Preferred Provider Benefit Plans.(b) Expenses of examination must be paid by each MEWA in the same manner and to the same extent as is provided for domestic insurance companies in Insurance Code §§401.151, concerning Expenses of Examination of Domestic Insurer; 401.152, concerning Expenses of Examination of Other Insurers; 401.155, concerning Additional Assessments; 401.156, concerning Deposit and Use of Assessment and Fee; and 1301.0056.28 Tex.
