Section 701.33 - Negotiation and Mediation of Certain Breach of Contract Claims(a) In accordance with Texas Government Code § 2260.052(c), the Institute adopts herein by reference the model rules provided by the Office of the Attorney General relating to procedures for the negotiation and mediation of certain contract claims asserted by contractors against the Institute.(b) The procedures, as adopted, are exclusive and required prerequisites to suit against the Institute under the Texas Civil Practice and Remedies Code, Chapter 107, and the Texas Government Code, Chapter 2260.(c) Nothing herein waives the Institute's sovereign immunity to suit or liability.(d) Unless specifically provided for by the Grant Contract, this rule does not apply to Grant Contracts. The Grant Contract shall specify the process and procedures for terminating a Grant Award, as well as any associated remedy.25 Tex. Admin. Code § 701.33
