Section 60.404 - Disqualification of the Mediator.

(a) If the mediator is a SOAH ALJ, that person will not be permitted to sit as the ALJ for the case if the contested matter goes to hearing.

(b) If the mediator is an employee of the department and the dispute does not settle, that mediator will not have any further contact or involvement concerning the contested matter.
