Section 60.37 - Voluntary Surrender of a License(a) A license holder may voluntarily surrender a license to the department by submitting a request in a form and manner prescribed by the department.(b) The request will be granted if the license holder: (1) holds a current, unexpired license that is not suspended or revoked;(2) does not have a pending complaint or a pending enforcement case; and(3) is not out of compliance with a disciplinary order.(c) The surrender of a license to the department is not a defense to an alleged or actual violation of any statutes or rules committed by the license holder. In addition, surrendering a license to the department in no way affects the authority of the department to initiate or continue any investigation or disciplinary proceeding concerning the license holder.(d) A license that has been voluntarily surrendered may not be renewed. A license holder who has voluntarily surrendered a license may apply for a new license.(e) Any fees paid on the license will not be refunded upon surrender.16 Tex. Admin. Code § 60.37
