Section 20.23 - ApplicabilityThe rules in this division do not apply to:
(1) an action of the Commission for which a contractor is entitled to a specific remedy pursuant to state or federal constitution or statute;(2) contracts between the Commission and the federal government or its agencies, another state or another nation;(3) contracts between the Commission and a local governmental body, or a political subdivision of another state;(4) contracts between a subcontractor and a contractor, when neither the contractor or the subcontractor is the Commission;(5) contracts within the exclusive jurisdiction of state or local regulatory bodies other than the Commission; or(6) contracts within the exclusive jurisdiction of federal courts or regulatory bodies.16 Tex.
