Section 1200-03-31-.05 - STANDARD FOR NEW SOURCES(1) Major sources shall utilize MACT as prescribed by the Technical Secretary upon start up regardless of whether or not the United States Environmental Protection Agency has established MACT under Section 112(d) or (h) of the Federal Clean Air Act. MACT shall be prescribed on the source's construction permit and transferred to the source's operating permit upon start up of the facility.(2) Area sources that are not exempt from the requirement to obtain a permit in accordance with Rule 1200-03-09-.04 shall utilize GACT as prescribed by the Technical Secretary upon start up if the United States Environmental Protection Agency has established GACT under Section 112(d)(5) of the Federal Clean Air Act. GACT shall be prescribed on the source's construction permit and transferred to the source's operating permit upon start up of the facility.Tenn. Comp. R. & Regs. 1200-03-31-.05
