Section 1140-03-.12 - STORAGE, SALE AND DELIVERY(1) All prescription drugs and controlled substances and devices and related materials shall be stored in an area not accessible to the public.(2) A controlled substance which is not a prescription drug under the Federal Food, Drug, and Cosmetic Act may be dispensed by a pharmacist without a prescription to a patient provided the pharmacist complies with the provisions of 21 CFR §1306.32 and any other applicable law.(3) Instruments and/or devices intended for the injection of any substance through the skin shall be stored in an area not accessible to the public, and shall be sold only on proof of medical need by a pharmacist or a pharmacy intern or pharmacy technician under the direct supervision of a pharmacist.(4) All insulin preparations must be stored in an area not accessible to the public, and shall be sold only by a pharmacist or a pharmacy intern or pharmacy technician under the direct supervision of a pharmacist.(5) Nothing in this section prohibits delivery of a prescription to a patient's home or business by an agent of the pharmacy practice site.Tenn.
