Section 0200-01-.18 - CIVIL PENALTIES(1) The Tennessee State Board of Barber Examiners may, in a lawful proceeding with respect to any person licensed or required to be licensed, in addition to or in lieu of any other lawful disciplinary action, assess civil penalties for violation of statutes, rules or orders enforceable by the Board in accordance with the following schedule: | Violation | Penalty |

(2) With respect to any person required to be registered in this state as a barber, the Board may assess a civil penalty against such person for each separate violation of a statute in accordance with the following schedule: | Violation | Penalty |

(3) In determining the amount of any penalty to be assessed pursuant to this rule, the Board may consider such factors as the following: (a) willfulness of the violation;(b) repetitions of the violation;(c) magnitude of the risk or harm caused by the violation; and(d) extent to which the licensee has sought to compensate any victim(s) of the violation.Tenn.
