Section 74:52:11:02 - Right of entry

Upon the presentation of credentials and other legal documents, an industrial user must allow the secretary to do the following:

(1) Enter the industrial user's premises where a regulated facility or activity is located or conducted or where records must be kept under the conditions of the permit;

(2) Have access to and copy any records pertaining to a direct or indirect discharge to waters of the state;

(3) Inspect any facilities; equipment, including monitoring and control equipment; practices; or operations regulated or required under the permit or pretreatment standards; and

(4) For the purposes of assuring permit compliance or as otherwise authorized by the CWA, sample or monitor any substances or parameters at any location.
