Section 74:51:01:64 - Notice requirements for certification of compliance with water quality standards for hydropower facilities

The secretary shall ensure that public notice of any proposed actions for water quality certification for hydropower facilities regulated by the Federal Energy Regulatory Commission is provided either by the responsible federal agency or by the department. The public notice for hydropower facilities shall follow requirements in § 74:52:05:13 and must be published in a daily or weekly newspaper that serves the affected area.
