Section 74:29:09:01 - Temporary cessation - When applicableA mining operation is in a state of temporary cessation when 180 days have elapsed during which no production occurred. A mining operation is not in a state of temporary cessation when one or more of the following occur:
(1) The mining operation resumes within one year and a statement is included in the mining operation permit that indicates the affected lands are to be used for less than 180 days each year;(2) Production has been completed and only final reclamation and related activities remain to be completed; or(3) A mining operation permit has been issued, but the mining operation has not begun.S.D.
