A hearing may be held on an application only if a petition requesting a hearing is filed by the secretary, any member of the board, the applicant, or an interested person within 30 days after the publication of the notice and recommendation. Petitions for hearing must conform to the contested case procedures of article 74:09. If a petition for contested case hearing is not filed on time, the recommendation of the secretary becomes the final decision on the application.
