A solid waste permit may be amended at any time by submittal of an application by the applicant or by filing a petition by the secretary or a member of the board. The application or petition shall specify the requested modification and the reasons for it. An application to amend a permit for a facility expansion must be submitted to the secretary within 180 days before the proposed date on which construction for the expansion is to begin. All other applications to amend a permit must be submitted at least 90 days before the proposed date on which changes are to be implemented. Applications for permit amendments must be in the form required to chapter 74:27:09 and are subject to the application fees in § 74:27:08:03.
