Section 70:03:01:07 - Restrictions on time of movement - Exceptions

Unless allowed in another section in this chapter, the following restrictions on time of movement apply to a permit issued according to this chapter.

Movement is restricted to daylight hours if one or more of the following conditions exist:

(1) An escort is required;
(2) The permit vehicle is not able to attain the speed of posted speed limits and is not able to maintain a speed within posted speed limits;
(3) The permit vehicle is wider than 10 feet;
(4) The permit vehicle is higher than 14 feet 6 inches;
(5) The permit vehicle is a single unit whose overall length exceeds 45 feet;
(6) The permit vehicle is a multiple-unit combination whose overall length exceeds 110 feet;
(7) The permit vehicle is a two-unit combination with an individual unit length longer than 60 feet;
(8) The permit vehicle is a three or more unit combination with an individual unit length longer than 48 feet;
(9) The permit vehicle will travel on state highways which are noninterstate and beyond a two-mile radius of an interstate highway interchange.

A permit issuing authority may place the daylight hours restriction on a permit if traffic, highway, or other conditions indicate the need for such a restriction.

In the best interest of public safety, a permit-issuing authority, with the concurrence of the secretary of the Department of Transportation or an authorized representative, may issue a permit to allow the movement of a permit vehicle anytime.

To facilitate the handling of a public emergency, a permit issuing authority may issue a permit to allow the movement of a permit vehicle anytime.
