Each agency that is not a governmental agency or federally recognized tribe, that provides intensive outpatient treatment services, day treatment services, clinically-managed, residential detoxification services, medically-monitored, intensive inpatient treatment services, or clinically-managed, low-intensity residential treatment services must be incorporated as, or as a part of, either a business corporation or a nonprofit corporation in accordance with SDCL chapters 47-1 A and 47-22 to 47-28, inclusive.
