Section 67:16:31:05 - Individuals eligible for Medicare must apply to Medicare

Individuals eligible for Medicare must apply to Medicare for coverage of any proposed transplant. A decision by Medicare that a transplant would not be covered by the Medicare program because the individual fails to meet the Medicare patient selection criteria is binding on the medical assistance program.
