Section 67:16:29:04 - Limits on the provision of medical equipment and suppliesThe provision of medical equipment and supplies is subject to the following requirements:
(1) The equipment and supplies must be medically necessary according to § 67:16:01:06.02;(2) The equipment and supplies must be prescribed in writing by a physician or other licensed practitioner for use in the recipient's residence. A recipient's residence does not include a nursing facility, an intermediate care facility for individuals with intellectual disabilities, or an institution for individuals with a mental disease;(3) The prescription must be signed and dated by the physician or other licensed practitioner before the covered medical equipment is provided. The effective date of the prescription is the physician or other licensed practitioner's signature date; and(4) When equipment is rented, the initial prescription is valid for no more than one year and must be renewed annually thereafter, unless the quantity, frequency, or duration of the recipient's need, as estimated by the physician or other licensed practitioner, has expired prior to the annual renewal. Documentation justifying continued use of rental equipment must be included in the medical record.S.D. Admin. R. 67:16:29:04
