Section 67:12:12:02 - Redetermination of deprivation for continued eligibility

In making a redetermination of deprivation of parental care or support for the purpose of determining continued eligibility for AFDC foster care, a recipient shall meet either of the following requirements:

(1) The recipient must meet eligibility criteria as established in chapter 67:12:01; or

(2) A court order has terminated parental rights during the period the recipient was receiving AFDC foster care benefits.
