Section 67:12:02:11 - Corrective payments

If the hearing decision is favorable to the aid to dependent children or aid to dependent foster children claimant or if the department decides in favor of the claimant before the hearing, the department shall promptly make corrective payments retroactive to the date the incorrect action was taken. Retroactive corrective payments may be made only for the 12 months preceding the month in which the underpayment is discovered.
