In a good cause investigation, before contacting the absent parent, the department shall notify the applicant or recipient of its intention to contact the absent parent. After notice, the department may not contact the absent parent if the applicant or recipient:
(1) Provides additional information or evidence that good cause exists;(2) Decides not to receive assistance;(3) Withdraws the good cause claim;(4) Requests a hearing; or(5) Removes the child from the application if the child is not required to be a part of the assistance unit according to § 67:12:01:69.S.D. Admin. R. 67:12:01:66.07
