If an employee fails to appeal within the time limits set in the appeal process, the failure to comply with the time limits is considered a withdrawal of the appeal. If the employer fails to comply with the time limit to respond to an appeal, the employee may initiate the next step in the appeal procedure. Either the employee or the employer may submit a written request for an extension of the time to appeal.
