Section 46:11:13:13 - Appeal of ineligibility of Level II determination

The individual, or the individual's legal representative, may request a fair hearing within 30 calendar days of receipt of the notice of ineligibility pursuant to SDCL chapter 1-26 by notifying the department orally or in writing. Any costs associated with legal counsel obtained to represent the individual are not the responsibility of the department.
