Section 46:11:05:09 - Chemical intervention

Any medication used with a behavior support plan pursuant to § 46:11:05:05.02 or any medication prescribed to manage behavior on an as needed basis shall be considered highly restrictive and shall meet the criteria set forth in § 46:11:05:06.01.

Medications used in conjunction with a behavior support plan shall require:

(1) The human rights committee and behavior support committee of the provider of direct HCB services to review and approve medications prior to administration and at least every six months thereafter; and
(2) The participants ISP shall include documentation of the teams consensus that the benefits of any medication prescribed for behavior management outweighs any harmful side effects and those side effects shall be documented in non-technical terms as well as a plan for reduction or elimination of the medication.
