Section 44:59:01:05 - Expert witness fee

The Department of Health shall assess a uniform expert witness fee for each court appearance by laboratory personnel or for failing to give 24 hours prior notice of any court cancellation. The fee may not exceed the cost incurred by the department to provide the service, including staff time and preparation. The fee shall be assessed in instances where there is a failure to give the required 24 hour notice of any court cancellation.
