For purposes of inland waters of the Missouri River, catfish are considered rough fish. Hoop net, trap, and setline licensees taking catfish from the Missouri River and its impoundments may sell, barter, or trade such fish, provided a receipt of sale is given to each purchaser, a record is kept by the licensee, and a report is provided to the state annually no later than December 31 of the year the transaction takes place. Failure to report is grounds for the department to refuse to issue hoop net and setline licenses the following year. Catfish taken from the South Dakota-Nebraska boundary water may not be sold, bartered, or traded.
